QANTAS FREQUENT FLYER TERMS AND CONDITIONS


Overview

Jaguar Land Rover Australia Pty Ltd has partnered with the Qantas Frequent Flyer program, enabling you to earn Qantas Points on eligible purchases.


1. Defined Terms

In these Terms and Conditions we use the following terms:
‘Award’ has the meaning given to it in the QFFP Terms.
'Earn Table' means the table set out in Appendix 1.
'Eligible Product' means new Jaguar or Land Rover vehicles purchased from an authorised Jaguar or Land Rover retailer (excluding Government and Fleet sales).
'Eligible Purchases' means purchases that are capable of earning Points but does not include:

i. On road costs, dealer delivery charges, luxury car tax, registration, stamp duty and GST;
ii. Purchase of any Used and Demo vehicles;
iii. Purchase of any Vehicles purchased for Government or Fleet use;
iv. Purchase of any Vehicle add-ons, including all factory fitted options, accessories and Jaguar and/ or Land Rover branded goods (each of which, even if included in the purchase price quoted by the authorised Jaguar Land Rover retailer, will not be included in the calculation of eligible purchase); or
v. Costs of Vehicle servicing.

'Jaguar Land Rover' means Jaguar Land Rover Australia Pty Ltd ABN 86 004 352 238.
‘Reward Flight’ has the meaning given to it in the QFFP Terms.
‘Other Benefits’ are other promotions and special benefits which may be offered to you from time to time.
'Promotional Period' means the period set out in the Earn Table.
‘Qantas Points’ means reward points awarded to a person who is a member of Qantas Frequent Flyer Program.
‘Qantas’ means Qantas Airways Limited ABN 16 009 661 901.
‘QFFP’ means the Qantas Frequent Flyer Program.
‘QFFP Account’ means your Qantas Frequent Flyer Program membership account.
‘QFFP Member’ means a member of the QFFP.
‘QFFP Terms’ means the Qantas Frequent Flyer Program Terms and Conditions.


2. Your eligibility to earn Qantas Points at Jaguar Land Rover

a) You are eligible to earn Qantas Points through Jaguar Land Rover, if:
i. You are an individual; and
ii. You are a member of the QFFP; and
iii. Your first accrual of Qantas Points are not earned through the purchase of a Jaguar or Land Rover vehicle.


3. Earning Qantas Points

a) Subject to clause 3(b)-(e), you will earn Qantas Points at the applicable rate specified in the Earn Table for Eligible Purchases made during the applicable Promotional Period. Please allow up to 60 days after purchase for Qantas Points to be credited to your QFFP Account.
b) Qantas Points can only be earned on eligible vehicle purchases where both the sales contract is signed and the vehicle’s warranty start date commences on a date falling within the relevant Promotional Period for that Eligible Purchase as set out in the Earn Table.
c) You will only earn Qantas Points with Jaguar Land Rover if you’ve supplied a valid QFF number and surname to your authorised Jaguar Land Rover retailer before payment.
d) Eligible purchases do not include:
i. On road costs, dealer delivery charges, luxury car tax, registration, stamp duty and GST;
ii. Used and Demo vehicles;
iii. Vehicles purchased for Government or Fleet use;
iv. Vehicle add-ons, including all factory fitted options, accessories and Jaguar and/ or Land Rover branded goods (each of which, even if included in the purchase price quoted by the authorised Jaguar Land Rover retailer, will not be included in the calculation of eligible purchase)
v. Vehicle servicing. 


4. How to Track Your Qantas Points

You can check the Qantas Points that you have earned through Jaguar Land Rover and your total points balance at qantaspoints.com/your-account.


5. How to Redeem Points

Qantas Points can only be redeemed through Qantas Frequent Flyer (not Jaguar Land Rover) in accordance with the QFFP Terms. To learn how you can redeem your Qantas Points and the range of redemption options, please visit qantaspoints.com.


6. Reversing Points

Jaguar Land Rover may request Qantas to reverse (debit) any Qantas Points that have been or are to be credited to a QFFP Account where there are grounds which Jaguar Land Rover consider reasonable to warrant a reversal including administrative error.


7. Bonus Qantas Points

From time to time, Jaguar Land Rover may make bonus Qantas Points offers. Separate terms and conditions may apply to these offers (in addition to these Terms and Conditions).


8. Claiming Qantas Points

Qantas Points will only be earned on eligible purchases that occur once your Qantas Frequent Flyer membership number has been added by the sales person at the authorised Jaguar Land Rover retailer to a purchase.


9. The Qantas Frequent Flyer Program

QFFP membership is determined by Qantas, not Jaguar Land Rover. QFFP membership, Qantas Points (including redeeming and expiry of Qantas Points following them being credited to your QFFP Account), the number of Qantas Points required for Rewards and changes to the number of Qantas Points required for Rewards are all subject to the QFFP terms and conditions.


10. Claims and Complaints

a) If you notify Jaguar Land Rover your QFFP Account has not been appropriately credited with Points to which you believe you are entitled in accordance with these and the QFFP Terms and Conditions (a “Claim”), then Jaguar Land Rover will, within 30 business days after receiving your Claim:

i. Advise you whether:
(a) You are not entitled to Qantas Points under these Terms and Conditions; or
(b) You are entitled to Qantas Points under these Terms and Conditions, in which case Jaguar Land Rover will then advise Qantas to credit your QFFP Account with those Qantas Points. Please allow up to 60 days after the day you are notified of this decision for your Qantas Points to be credited to your QFFP Account; and

ii. Provide a reason for that decision.

11. Privacy and Consents

Jaguar Land Rover respects your privacy. We collect, store and use your personal information in accordance with our Privacy Policy, the Privacy Act 1988 (Cth) and all other applicable privacy laws. Jaguar Land Rover Privacy Policy may be found at here.
a) Jaguar Land Rover may collect and hold personal information about you including your name, age, address, telephone number, email address, current vehicle information, information about the motor vehicle dealership from which you purchased the vehicle, service history and your contact preferences.
b) Jaguar Land Rover will usually disclose personal information to:
i. Our business partners, including service providers, such as mail houses, website and IT service providers and roadside assistance providers, who assist us in providing products and services and information about the products and services of us and our business partners to you and to our business partners.
ii. Qantas Frequent Flyer Program (QFFP) and Qantas Business Rewards only for the purposes of crediting Qantas Points to the member’s account. This will include First Name, Last Name, address, phone number, mobile number, and QFF Number (Qantas Frequent Flyer only) OR ABN (Qantas Business Rewards only)
iii. Other members of the Jaguar Land Rover Group of companies.

c) You may access or correct your personal information held by Jaguar Land Rover, or make a complaint about its privacy practices, as described in the Jaguar Land Rover Privacy Policy.


12. No Liability

The Qantas Frequent Flyer Program is operated by Qantas. Either Jaguar Land Rover or Qantas may terminate Jaguar Land Rover’s participation in the Qantas Frequent Flyer Program. Jaguar Land Rover will have no liability for any changes to the Qantas Frequent Flyer Program or if the relationship between Jaguar Land Rover and Qantas with respect to the Qantas Frequent Flyer Program is terminated. Jaguar Land Rover is not liable for any action taken by Qantas with respect to the implementation of the Qantas Frequent Flyer Program (including, but not limited to, any changes to the right to redeem points for Awards or Rewards or any refusal to issue points to a participant). Jaguar Land Rover cannot ensure that a participant will be able to redeem points for any particular Awards or Rewards and expressly disclaims any liability with respect to redemption.


13. Changes to these Terms and Conditions

a) Jaguar Land Rover reserve the right to change, suspend or terminate these Terms and Conditions at any time.
b) Where Jaguar Land Rover changes these Terms and Conditions, or any benefits under the QFFP, an updated copy of these Terms and Conditions will be available on the Jaguar website here, and Land Rover website here. Members should regularly check for updates to the Terms and Conditions.

QANTAS BUSINESS REWARDS LOYALTY PROGRAM REWARD SCHEME TERMS AND CONDITIONS



1. Introduction

1.1 These Terms and Conditions:
a) Apply to and govern the contractual relationship between the Program Partner and each Member with respect to the Reward Scheme made available by the Program Partner as a participant in the Qantas Business Rewards Program;
b) Are effective as at the date specified above and may be amended from time to time; and
c) Operate in conjunction with the Qantas Business Rewards Program Terms and Conditions (available at www.qantasbusinessrewards.com) and in the event of any inconsistency or conflict the Qantas Business Rewards Program Terms and Conditions prevail.

1.2 The current Reward Scheme Terms and Conditions are available on the Jaguar website here, or the Land Rover website here. It is the Member’s responsibility to read and understand them. Any queries regarding these Terms and Conditions should be directed to the Program Partner.


2. Definitions

2.1 Unless the context otherwise requires:
a) Terms used in the Qantas Business Rewards Program Terms and Conditions and the Qantas Frequent Flyer program Terms have the same meaning in these Terms and Conditions; and
b) The following terms have these meanings in these Terms and Conditions.
Earn Table means the table set out in Appendix 1.
Eligible Products means new Jaguar or Land Rover vehicles purchased from an authorised Jaguar or Land Rover retailer (excluding Government and Fleet sales).
Member means a member of the Reward Scheme.
Program Partner means Jaguar Land Rover Australia Pty Ltd ABN 86 004 352 238.
Program Partner Earn Table means, for the purposes of these Terms and Conditions, the table set out at the bottom of these Terms and Conditions.
Promotional Period means the period set out in the Earn Table.
Reward Scheme means, for the purposes of these Terms and Conditions, the Jaguar Land Rover Loyalty Program Reward Scheme which is operated by the Program Partner.
Terms and Conditions means these terms and conditions which apply to the Reward Scheme and which are administered by the Program Partner.

2.2 In these Terms and Conditions, unless the contrary intention appears:
a) The singular includes the plural and vice versa; and
b) A reference to ‘include’ or ‘including’ means ‘including but not limited to.



3. Application of Reward Scheme Terms and Conditions

By claiming any Qantas Business Rewards Benefit under the Reward Scheme, a Member agrees to be bound by these Terms and Conditions in addition to the Qantas Business Rewards Program Terms and Conditions.


4. Changes to Reward Scheme

4.1 Subject to clause 4.2 and the Reward Scheme Terms and Conditions, the Program Partner may implement any changes (whether material or otherwise) to these Terms and Conditions and the Qantas Points offered in relation to Eligible Products, including changes to:
a) The ways in which Qantas Points are earned under the Reward Scheme; b) What constitutes Eligible Products; and c) Restrictions, conditions and eligibility to earn Qantas Points under the Reward Scheme.

4.2 The Program Partner will inform Members of material changes to these Terms and Conditions and where such changes will reduce the number of Qantas Points offered to Members under the Reward Scheme, when possible, give Members at least 30 days’ notice.
4.3 Without limiting clause 4.1 in any way, Members will be taken to have received the notice referred to in clause 4.2 if the Program Partner or Qantas Business Rewards Program notifies Members of the change by sending an email to the email address in the Membership Account.

5. Termination or suspension of the Reward Scheme

5.1 The Program Partner gives no undertaking as to the continuing availability of the Reward Scheme. The Program Partner may terminate or suspend the Reward Scheme at any time. and will give at least 60 days’ notice to Members of such termination or suspension, except if the Qantas Business Rewards Program ceases to operate, in which case the Reward Scheme will cease immediately.
5.2 If the Program Partner terminates or suspends the Reward Scheme, subject to the Qantas Business Rewards Program Terms and Conditions Members will be able to transfer Qantas Points during the notice period, except where:
a) Qantas is ceasing to operate an airline business and/or has gone into liquidation, receivership or other form of administration; and/or
b) The Program Partner ceases to operate its business and/or has one into liquidation, receivership or other form of administration, in which case Qantas Points in Qantas Business Rewards may be cancelled without notice.


6. Earning Qantas Business Rewards Benefits

6.1 Subject to the exclusions, limitations and other conditions specified in this clause 6, the Program Partner will award Qantas Business Rewards Benefits to Members at the applicable rate specified in the Earn Table, or in any special offer, for Eligible Products paid for by the Member for the Member’s business related purposes during the relevant Promotional Period.
6.2 No Qantas Business Rewards Benefits will be awarded if the Eligible Product is cancelled, refunded or returned.
6.3 Members are not entitled to claim Qantas Business Rewards Benefits under the Reward Scheme for:
a) On road costs, dealer delivery, luxury car tax, registration, stamp duty or GST;
b) Purchase of any used and demo vehicles;
c) Vehicles purchased for Government or Fleet use
d) Purchase of any vehicle add-ons, including all factory fitted options, accessories and Jaguar and/or Land Rover branded goods (each of which, even if included in the purchase price quoted by the authorised Jaguar Land Rover retailer, will not be included in the calculation of Eligible Purchase under the Reward Scheme);
e) Costs of vehicle servicing.

6.4 Points can only be earned on new eligible vehicle purchases where both the sales contract is signed and the vehicle’s warranty start date commences on a date falling within the relevant Promotional Period for that Eligible Purchase as set out in the Earn Table.
6.5 To earn Qantas Business Rewards Benefits in relation to an Eligible Product, the Member must quote its ABN and at the time of purchasing an Eligible Product and must comply with any other requirements or procedures advised by the Program Partner prior to the purchase.
6.6 It is the responsibility of the Member to check whether a product or other activity is eligible to earn Qantas Business Rewards Benefits, and if so how many Qantas Points or which other Qantas Business Rewards Benefits will be earned, before making a purchase or undertaking the relevant activity.
6.7 Members must provide the Program Partner on request with documented verification of the purchase of an Eligible Product. The Program Partner reserves the right to deny or revoke the crediting of Qantas Points in Qantas Business Rewards at any time if the Program Partner determines that Qantas Points were improperly obtained or erroneously credited to a Member’s Membership Account.
6.8 Unless otherwise determined by the Program Partner, Members are not eligible to earn Qantas Points in the Reward Scheme if they have their principal place of business outside Australia.
6.9 The Program Partner may offer additional opportunities to earn Qantas Points in Qantas Business Rewards under a special promotion from time to time, in which case the terms and conditions referred to in the promotion will apply.

7. Crediting Qantas Points in Qantas Business Rewards

7.1 The Program Partner will endeavour to instruct Qantas Business Rewards to credit the applicable number of Qantas Points to the Membership Account within 60 days after the purchase of an Eligible Product. It is the responsibility of the Member to check that the correct number of Qantas Points has accumulated in the Membership Account.
7.2 Claims for the crediting of Qantas Points in Qantas Business Rewards retrospectively must be made by the Member to the Program Partner within 90 days after the purchase of an Eligible Product. Unless otherwise specified by Qantas Business Rewards, claims for the crediting of Qantas Points cannot be made if the Membership is not current or if the Membership Account was not active at the time the Eligible Product was purchased.

8. Suspension or termination of a Member or Qantas Points in Qantas Business Rewards

8.1 The Program Partner reserves the right to terminate a Member’s participation in the Reward Scheme or withhold or cancel Qantas Points claimed under the Reward Scheme if a Member or any of the Member’s representatives has attempted to claim Qantas Points under the Reward Scheme to which they were not entitled.
8.2 The Program Partner and Qantas Business Rewards will not be liable for any loss or damage whatsoever suffered by any person as a result of such withholding or cancellation and the Member is responsible for ensuring that its nominated Qantas Points Recipients are notified of this.

9. Personal Information

c) You may access or correct your personal information held by Jaguar Land Rover, or make a complaint about its privacy practices, as described in the Jaguar Land Rover Privacy Policy.


10. Taxation Implications

10.1 The Program Partner recommends that Members and their nominated Qantas Points Recipients consult their accountant or tax adviser to ensure that they understand possible tax (including fringe benefits tax) implications, if any, related to their earning and use of Qantas Points under the Reward Scheme.
